1 Seller, scope, language
These terms apply to all purchases on https://kiekkist.de. The seller and your contract partner is Till Heidrich – Content Creation | Heidrich Digital, Rotdornweg 17, 21255 Tostedt, Deutschland, email mail@heidrich-digital.de, phone 0157 73953819 ("we").
A consumer is anyone who buys mainly outside a trade, business or self-employed profession (Section 13 German Civil Code, BGB). A business customer buys for such an activity (Section 14 BGB); freelancers and founders count as business customers. Sections that apply to one group only are marked.
The contract languages are German and English. Both versions are equally complete.
2 Products
Kiekkist Free (no charge): skill, tool and three free designs. Their own open-source or free licences apply, not these terms.
All products are one-time purchases. There are no subscriptions, no terms and no automatic renewal.
Single design: one gallery design for unlimited websites, your own and your clients'.
All-Access: every design in the gallery at purchase and every design released in the 12 months after the purchase, with the same licence.
What you may do with the designs is set out in the licence terms. They are part of the contract.
3 How the contract is made
The website is not yet an offer. In the order form you state whether you buy as a private individual or for your business, plus name, email and country, and where needed address, company and VAT ID. Before submitting you see the product, the licence scope and the price, and you can correct every entry.
Clicking "Buy now (payment required)" is a binding offer. We accept it when the payment with Mollie succeeds. You then receive a confirmation email with your licence key, the invoice as PDF and, as a second PDF attached to it, these terms, the licence terms and the withdrawal information in full. We do not keep the contract text available for you; it is contained in full in that email and its attachment.
By ordering you confirm that you are at least 18 years old.
4 Prices and payment
The prices shown before ordering apply. They are final prices. No VAT is charged under the small business exemption (Section 19 German VAT Act). There are no other charges; your bank may charge its own fees for payments in a foreign currency.
Payment is processed by Mollie B.V., Amsterdam, with the methods offered there. It is always a single payment; we never collect anything later.
We sell to consumers in the EU, Switzerland, the US, Canada, Australia and Norway, and to businesses worldwide (except countries under embargo). We currently do not sell to consumers in the United Kingdom.
Credit: if you buy All-Access within 30 days of single designs, we credit the full price of those single designs. Each purchase is credited only once.
Founding price: a founding price for All-Access shown at purchase applies to that purchase.
5 Delivery
You receive the designs as a ZIP file through a time-limited download link or through the Kiekkist connector (MCP) in your AI assistant. We email the licence key right after payment; it is also shown on the confirmation page. With every retrieval you register a project name (proof of licence, not copy protection).
Before the first download we ask consumers whether the content should be provided before the withdrawal period ends (section 7).
6 One-time purchase, updates, continuity
The contract is fulfilled with payment and delivery; there is no continuing obligation and nothing to cancel.
Licences are perpetual. You receive new pages, variants and fixes of a purchased design for 12 months from purchase (date in the licence key). After that you may keep using everything you received up to then.
The downloaded files are yours to use under the licence terms. No feature of the designs depends on our server after download. Licences can be verified without our server (public key in the package). If we ever discontinue Kiekkist, files and licences stay valid.
7 Right of withdrawal (consumers only)
As a consumer you have a statutory right of withdrawal, see the withdrawal information. You can withdraw online via "Withdraw from contract" (https://kiekkist.de/withdraw/).
For digital content the right of withdrawal ends if, before the first download, you expressly agree that we deliver before the withdrawal period ends, confirm that you thereby lose your right of withdrawal, and we have confirmed this statement to you by email.
Business customers have no statutory right of withdrawal; the voluntary guarantee applies to them (section 8).
8 Voluntary money-back guarantee
30-day money back, no questions asked: write to us within 30 days of payment and you get the full amount back, even if you have already downloaded. With the refund the licence for the affected designs ends. Applies to the first purchase per customer or company. This voluntary guarantee is in addition to your statutory rights (right of withdrawal and statutory warranty) and does not limit them.
How: reply to the order confirmation or email mail@heidrich-digital.de with your order number. The refund goes to the same payment method. With the refund the licence ends; you may then no longer use the affected designs in projects.
9 Defects and updates
Consumers have the statutory rights for digital products (Sections 327 et seq. BGB) without restriction. For business customers the statutory warranty applies with a limitation period of one year, except for intent, gross negligence and injury to life, body or health.
What the design page states (check results, accessibility, tested versions) is the agreed quality at the time of purchase. We provide security fixes for at least 24 months from purchase. New pages and variants are included for 12 months from purchase (date in the licence key).
10 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and where we have given a guarantee.
For slight negligence we are liable only for breach of an essential contractual obligation, meaning an obligation whose fulfilment makes the contract possible and on which you may rely, and then limited to the foreseeable damage typical for the contract.
Business customers only: in these cases liability is additionally limited to the fees paid in the last twelve months.
11 Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, write to us: mail@heidrich-digital.de.
12 Law, jurisdiction, final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. As a consumer you keep the protection of the mandatory provisions of the country where you live.
Only for merchants, public-law entities and customers without a place of jurisdiction in Germany: the place of jurisdiction is the seller's registered address.
Business customers only: if a provision is invalid, the rest remains valid.
